1. Agreement to these terms

These terms govern your use of the Motkan.ai website and any services we make available through it. By accessing or using the site, you agree to these terms. If you do not agree, please do not use the site.

“Motkan,” “we,” “us,” and “our” refer to Motkan and its real-estate division. Motkan operates as part of the broader Motkan group and builds AI systems and automations for real estate.

2. Our services

Motkan designs, builds, integrates, and operates AI systems and automations for real estate teams — including instant lead response, qualification, follow-up and database reactivation, showing coordination, listing and back-office operations, and custom workflows built around your CRM, portals, calendars, and channels.

The website provides general information about our offerings. It is not an offer or a binding quote. Any engagement we take on is governed by a separate written agreement or statement of work, which sets out scope, fees, timelines, and responsibilities. Where that agreement conflicts with these terms, the agreement controls for that engagement.

3. Website use license

We grant you a limited, non-exclusive, non-transferable license to access and view the website for your personal or internal business use. You may not:

• Copy, modify, or create derivative works from the site except as needed to view it
• Use the materials for any unlawful purpose or unauthorized commercial exploitation
• Attempt to decompile, reverse engineer, or extract source code or models
• Remove any copyright, trademark, or other proprietary notices
• Scrape, mirror, or republish the site or its content on another server

4. AI-generated output

Our systems use artificial intelligence to generate messages, summaries, and other content. AI output can be inaccurate, incomplete, or unexpected, and should be reviewed by a qualified person before being relied upon. We do not warrant that AI output is error-free or fit for any particular purpose.

When we operate a system on your behalf, you are responsible for how it is used and for compliance with all laws that apply to your business — including fair housing and anti-discrimination rules, advertising and consumer-protection laws, and communication and consent requirements (such as those governing email, SMS, and automated messaging). You are responsible for obtaining any consents needed to contact your leads and customers.

5. Acceptable use

You agree not to use the website or Services to:

• Violate any law or the rights of others
• Send unlawful, deceptive, or unsolicited communications
• Upload malicious code or attempt to disrupt or gain unauthorized access to our systems
• Interfere with another party’s use of the Services

6. Intellectual property

The website and the Services — including software, models, designs, text, and branding — are owned by Motkan or its licensors and are protected by intellectual property laws. Ownership of deliverables and any client data is addressed in the separate agreement for each engagement. Nothing here transfers any intellectual property rights except as expressly stated.

7. Third-party services and integrations

The Services may connect to or rely on third-party tools — such as CRMs, lead portals, calendars, messaging platforms, and AI model providers. We are not responsible for the availability, accuracy, or practices of third parties, and your use of those tools is subject to their own terms.

8. Disclaimer

The website and its materials are provided “as is” and “as available.” To the fullest extent permitted by law, Motkan disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site or Services will be uninterrupted, error-free, or secure.

9. Limitation of liability

To the fullest extent permitted by law, Motkan and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the website or Services — even if advised of the possibility of such damages. Liability for any engagement is addressed in the applicable agreement.

10. Changes to these terms

We may revise these terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Your continued use of the website after changes take effect means you accept the revised terms.

11. Governing law

These terms are governed by the laws of the jurisdiction in which Motkan operates, without regard to conflict-of-laws principles, and you agree to the exclusive jurisdiction of the courts in that location.
